Welcome to www.equinedonations.com (the "Website"). This Website and the appraisal, valuation, and related services offered herein (collectively, the "Services") are owned and operated by Stier Horse ("Company," "we," "us," or "our").
By accessing the Website, submitting information, or purchasing our Services, you ("User," "Client," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are expressly prohibited from using the Website or our Services.
1. SCOPE OF SERVICES
Stier Horse provides professional valuation, consultation, and appraisal services for horses and related equine assets, often utilized for donation, tax, sale, or insurance purposes.

Our appraisals represent a professional opinion of value based on equine genetics, pedigree, competition records, market trends, and data provided by the Client.

An appraisal is an opinion of value and does not constitute a legal or financial guarantee of sale price, IRS acceptance, or market performance.
2. FEES AND PAYMENT TERMS

Upfront Payment Required: All fees for appraisal and valuation services are due and payable in full, upfront at the time the order is placed or prior to the commencement of any research, analysis, or drafting.

Non-Refundable: Because our Services involve immediate allocation of research, labor, and specialized expertise, all payments are non-refundable once work has commenced, regardless of the final valuation outcome.

Payment Processing: Payments are processed securely via our designated third-party payment gateways. You agree to provide current, complete, and accurate purchase and account information.
3. CLIENT REPRESENTATIONS & RESPONSIBILITIES
To perform an accurate appraisal, you must provide complete, accurate, and truthful information regarding the equine subject (including but not limited to registration papers, pedigree, health history, training, show records, and ownership status).

You represent and warrant that you either own the horse being appraised or have explicit legal authority from the owner to seek appraisal services.

The Company is not responsible for errors, omissions, or inaccurate valuations resulting from false, misleading, or incomplete information provided by the Client.
4. INTELLECTUAL PROPERTY & DATA USE FOR MARKETING

Proprietary Rights: The Website, its content, design, logos, text, and the structural format of our final appraisal reports are the intellectual property of Stier Horse and are protected by copyright and trademark laws.

Limited License to Reports: Upon full payment, the Client is granted a non-exclusive, limited license to use the final appraisal report for its intended purpose (e.g., tax documentation, insurance, estate planning). The report may not be altered, excerpted, or used for commercial marketing by the Client without our prior written consent.

Marketing Use of Data: By submitting data, photographs, competition records, or pedigrees to the Website, you grant Stier Horse a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, and display non-personally identifiable asset data (such as horse names, bloodlines, performance achievements, and valuation statistics) for industry benchmarking, case studies, statistical analysis, and Company marketing purposes. We will never disclose your sensitive financial data or personal identity for marketing purposes without explicit consent.
5. INDEPENDENT APPRAISER STATUS & COMPLIANCE
Our appraisals are conducted in accordance with standard professional equine valuation principles. However, Stier Horse does not provide legal, tax, or certified public accounting (CPA) advice.

It is the sole responsibility of the Client to ensure that any appraisal intended for tax-deductible charitable donations complies with current IRS regulations, Uniform Standards of Professional Appraisal Practice (USPAP), or relevant local tax laws.

The Client should consult a qualified tax professional regarding the specific tax implications of their donation.
6. DISCLAIMER OF WARRANTIES
THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. STIER HORSE DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR SPECIFIC EXPECTATIONS OR THAT THE IRS OR ANY THIRD PARTY WILL ACCEPT THE VALUATION RENDERED.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STIER HORSE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
8. INDEMNIFICATION
You agree to defend, indemnify, and hold Stier Horse harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand (including reasonable attorneys' fees) made by any third party due to or arising out of: (a) your submission of inaccurate or fraudulent equine data; (b) your use of the Services; or (c) a breach of these Terms.
9. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and your use of the Website and Services are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Beaverton, Oregon, and the parties hereby consent to personal jurisdiction and venue therein.
10. CHANGES TO THESE TERMS
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms. Your continued use of the Website or Services after the date such revised Terms are posted constitutes your acceptance of the changes.
